Emotional Support Animals and service animals are treated differently under federal law. Unlike qualifying service animals, ESAs generally do not have automatic public-access rights simply because they have an ESA letter.

For example, an ESA may not automatically be permitted inside restaurants, retail stores, workplaces, public transportation, or other locations that do not generally allow pets. If you want to bring an ESA into a particular business or establishment, you should ask the owner or manager about their current pet and animal policies and respect their decision.

Air travel has its own requirements. Emotional Support Animals generally do not receive the same federal airline protections as trained service animals. Airlines may therefore treat an ESA as a pet and apply their own policies regarding carriers, size, documentation, fees, and cabin access.

If an airline does not recognize your ESA for special accommodation, you may still be able to travel with the animal under the airline’s standard pet policy, provided you meet all applicable requirements.

If an individual needs an animal that performs specific disability-related tasks, a properly trained psychiatric service dog may fall under different legal protections. However, an ESA cannot simply be labeled a service animal without meeting the applicable definition and training requirements.

Housing is one of the areas where ESAs receive important federal protection. Under the Fair Housing Act (FHA), qualifying individuals with disabilities may request reasonable accommodation to live with an assistance animal, including an Emotional Support Animal.

A properly supported accommodation request may apply even when a landlord or property has a general no-pet policy. When an accommodation is approved, ordinary pet-related restrictions or charges may not apply in the same way as they would to a typical pet.

However, housing providers may still evaluate whether an accommodation is reasonable and may address legitimate concerns involving health, safety, sanitation, animal behavior, or property damage. Applicants should provide appropriate documentation when required and communicate clearly throughout the accommodation process.

ESA housing protections do not eliminate an owner’s responsibility to properly care for and control their animal. Owners should maintain appropriate cleanliness, prevent unreasonable disturbances, respect shared spaces, and take reasonable steps to avoid property damage or safety concerns.
