While Idaho does not provide broad, state-specific public-access rights for ESAs, qualifying individuals may still have important protections under federal housing law. With appropriate professional documentation, an eligible person may be able to:

• Live with an ESA in qualifying housing, including certain properties with no-pet policies.
• Request reasonable housing accommodation when the animal is needed because of a qualifying disability.
• Avoid certain pet-related fees or restrictions when they are not permitted under applicable housing requirements.
• Receive protection from housing discrimination under the federal Fair Housing Act.

An ESA is different from a trained service animal, so understanding the specific law that applies to your situation is essential.

Getting appropriate ESA documentation does not have to be complicated. The process generally begins with an evaluation by a qualified licensed mental health professional who can assess your circumstances and determine whether an Emotional Support Animal is appropriate for your disability-related needs.

Telehealth services can make this process more convenient for Idaho residents by allowing eligible individuals to connect with a licensed professional remotely rather than arranging an in-person appointment. A legitimate online ESA process should involve a genuine professional evaluation and should never be based solely on purchasing an instant certificate or registration.

However, housing providers may still evaluate whether the requested accommodation is reasonable and may address legitimate health, safety, sanitation, behavioral, or property concerns.

The rules for traveling with an ESA are different from housing protections. Changes to federal air-travel regulations mean Emotional Support Animals generally do not have the same special status in air transportation that qualifying trained service animals have.

Airlines may therefore treat ESAs as pets and apply their own policies, including carrier requirements, size restrictions, documentation requirements, and applicable fees. Travelers should always check the airline’s current rules before booking a flight.

Qualifying service animals are subject to different federal air-travel protections and may be permitted to travel with their handlers without ordinary pet fees when applicable requirements are met.
